GENERAL TERMS AND CONDITIONS OF CONTRACTING
1. PURPOSE
The general terms and conditions set forth below are intended to regulate the services provided, whether for obtaining a tourist license or a tourist rental registration number. These services will be provided by Celia Parejo Horrillo, with registered address at Urbanización Islantilla Real, P.º del Golf, 20, Casa 20, CP 21430 Islantilla, Huelva.
Contracting any of the services offered implies full and unreserved acceptance of the provisions set out in this document, as well as those in the Privacy Policy. The contracting party also declares that they are of legal age, fully capable of entering into this agreement under applicable law, and legally authorized to act either on their own behalf or on behalf of a third party. Furthermore, they declare that all the information provided is truthful and up to date. Acceptance will be understood as tacit through clicking the checkbox enabled for this purpose.
2. SERVICES
Registro Vivienda Turística offers users two types of services: the processing of the Tourist License and the acquisition of the Rental Registration Number.
Please note that in both cases, the Administration may require additional documentation not initially submitted, and obtaining such documentation may incur additional fees for the client.
2.1. Processing the Tourist License
This refers to the process aimed at obtaining a tourist license for a specific property, excluding any other procedure required to obtain related documentation. In that case, a separate service must be contracted. The service is considered completed once the deadline given to the Administration to respond has passed. However, the total duration of the procedure depends on the deadlines set by the Administration and any delays that may occur.
Since this matter is regulated by the Autonomous Communities and their local entities, the processing of each license will comply with the specific applicable regulations, which may vary in terms of requirements, resolution times, or documentation.
If additional documentation or corrections are required and cannot be provided within the given timeframe due to the client’s inaction, the service will be considered completed, and no refund will be issued.
In the case of an unfavorable resolution or the revocation of the license by the authorities, the amount paid will not be refunded unless due to malpractice. If so, the full amount will be reimbursed.
The provider assumes no responsibility for any false or inaccurate data provided by the client, particularly in the responsible declaration submitted by the client.
2.2. Obtaining the Rental Registration Number
This refers solely to the procedure to obtain the rental registration number and does not include any subsequent obligations, which remain the sole responsibility of the landlord. Once the required documentation has been provided, the service is considered initiated and will conclude upon obtaining the final registration number. The stated price does not include any other procedures necessary for its acquisition, such as missing documents. However, a separate service may be contracted to obtain such documents.
The provider assumes no responsibility for any false or inaccurate data provided by the client, particularly in the responsible declaration submitted by the client. The following obligations, established in Article 5 of Royal Decree 1312/2024 of December 23, remain the sole responsibility of the property owner or client:
«c) Respond to information requests from competent authorities regarding their units.
d) Update the submitted information regarding their units upon any changes.
e) Inform online platforms of the registration number assigned to their unit by the Property or Movable Assets Registry to advertise on those platforms.»
If additional documentation or corrections are required and not provided within 7 business days due to the client’s inaction, the service will be considered completed without the right to a refund.
If an unfavorable resolution is issued or the registration number is revoked, no refund will be granted unless due to malpractice, in which case the full amount will be reimbursed.
The total duration of the procedure depends on the Administration’s timelines and potential delays.
3. CONTRACTING PROCEDURE
To contract the offered services, the client must select the desired service on the relevant webpage and accept the present conditions.
The contracting process involves the following steps:
Service Selection: The user selects the desired service.
Payment: The user proceeds to payment via the available methods.
Required Information: The user submits the requested information, including property details, legal documents, and other relevant data.
4. PRICES AND PAYMENT METHODS
The price of each service is clearly detailed at the time of contracting. Fees are €99 and €89, plus applicable taxes and administrative fees. If both services are contracted, a discount will apply, resulting in a combined price of €169, excluding VAT and additional fees. A discount will also apply for multiple properties:
2 properties: 10%
3 properties: 15%
4 or more: 20%
This discount does not apply when both services are contracted together, as a separate discount has already been applied.
Payment can be made via various methods: bank card, transfer, PayPal, etc. All payments are processed through secure, encrypted channels. At no time will we have access to your card or account details.
The provider reserves the right to modify prices at any time without affecting already contracted services.
5. DEADLINES
REGISTRO VIVIENDA TURÍSTICA commits to providing the service within a maximum of 5 business days. However, this may vary depending on the competent authorities and specific requirements of each Autonomous Community. Delays may also occur if the Administration requests additional documentation or information.
6. CLIENT OBLIGATIONS
The client agrees to:
Provide truthful and up-to-date information throughout the procedure.
Assume full responsibility for any use of false, inaccurate, or fraudulent data provided.
Comply with all legal requirements for obtaining the tourist license or rental registration number.
Pay the total amount under the established terms.
7. OBLIGATIONS OF REGISTRO VIVIENDA TURÍSTICA
The provider agrees to perform the services in accordance with applicable regulations and with the highest diligence and quality standards. However, it is not responsible for delays caused by administrative bodies or inaccuracies in the data provided by the client.
8. RIGHT OF WITHDRAWAL
In accordance with applicable law, the client may exercise the right of withdrawal within 15 days of contracting, provided the service has not yet been partially or fully executed.
To exercise this right, the client must notify info@registroviviendaturistica.com in writing, and a refund will be issued accordingly.
9. PERSONAL DATA PROTECTION
Personal data will be processed confidentially, applying the technical and organizational measures required, and will not be shared with third parties without explicit consent. See the Privacy Policy for more details.
10. MODIFICATIONS AND UPDATES
REGISTRO VIVIENDA TURÍSTICA reserves the right to make any changes it deems necessary to the services, pricing, or these terms without prior notice. These changes will not affect existing contracts.
11. INTELLECTUAL AND INDUSTRIAL PROPERTY
All website content, including text, images, logos, and other elements, is protected by intellectual and industrial property rights and may not be reproduced without proper authorization.
12. DURATION AND TERMINATION OF CONTRACT
The contract ends once the tourist license or rental registration number is obtained, or after the administration’s review period expires. It may also be terminated early if either party breaches their obligations. Termination must be properly notified and documented.
Personal data will be retained according to the Privacy Policy.
13. APPLICABLE LAW AND JURISDICTION
These terms are governed by Spanish law. Any dispute shall be submitted to the Courts of Fuengirola, waiving any other applicable jurisdiction, except where prohibited by law.
